Actions to be Taken in Turkey as a result of the Divorce Case in Germany

Because the divorce decisions given by the states’ own courts; If recognition and enforcement action is not filed, it does not become valid in Turkey.

This situation makes it obligatory to open the case of recognition and enforcement of divorce in Turkey in accordance with International Private Law. At this point, people who have divorced in Germany should definitely file a recognition and enforcement action.

In the event that Turks residing in Germany terminate their marriage with another Turkish citizen or a foreign citizen in Germany and do not file a recognition enforcement case due to divorce, some legal consequences arise against them.

The legal consequences in question are as follows;

1- Your ex-spouse’s status of legal heirship continues unless the case of recognition and enforcement of the divorce is filed in Turkey due to divorce in Germany. (This may harm you and your heirs during the sharing of the inheritance in the future)

2- If you do not file a recognition-enforcement case in Turkey despite your divorce in Germany, you will continue to appear married before Turkish institutions. Therefore, if you want to get married again, this situation will come up.

2-An annotation or document showing that the court decision as a result of the Divorce Case in Germany has become final.

3- Adding an Apostille document according to the 1961 Hague Convention by the German Court or the competent authority to the court decision and the finalization annotation or document given in Germany.

4-Translation of the decision of the German court, the annotation of finalization and the apostille approval to a sworn Turkish translator.

5-Consulate approval for sworn translation.

6-The special power of attorney for enforcement to be given to your lawyer.

You do not need to come to Turkey for divorce in Germany and for the recognition and enforcement of decisions regarding this divorce.
